Most Medical Schools Offer Poor Mental Health Coverage
Most U.S. medical schools offer their students poor health insurance coverage for the treatment of mental health and substance use disorders, researchers report. In a study published in the Journal of the American Medical Association, they found that fewer than 22 percent of the 115 medical schools studied provided their students with complete coverage, without co-pays or coinsurance, for mental health and substance use treatment. Medical students face intense stresses from their work, but many don’t reach out for help. "Research shows out-of-pocket costs discourage patients from getting mental health and substance abuse treatment," said Dr. Rachel Nardin, assistant professor of neurology at Harvard Medical School, chief of neurology at CHA and lead author of the study. ERs Aren’t Evaluating Self-Harm Patients: Study
Doctors in the emergency rooms often don't evaluate the mental health of patients who've cut or otherwise hurt themselves before sending them home, a new study shows. Less than 48 percent of patients who were discharged after self-harming had a mental health assessment while in the ER, researchers report in the Archives of General Psychiatry. An equal proportion of them don't get follow-up therapy in the next month, the researchers found. Yet those people have higher rates of suicide and are especially vulnerable soon after a self-harm incident, according to researchers. (Fox News, 9/8/11)
Canadians Say Entry to US Blocked Over Mental Health Records
More than a dozen Canadians have told the Psychiatric Patient Advocate Office in Toronto within the past year that they were blocked from entering the United States after their records of mental illness were shared with the U.S. Department of Homeland Security. Canadian officials say it could result from records stored in a database of police records that American authorities can access when screening visitors to the country. Even when police respond to non-violent incidents linked to someone's mental health problems, a record of it ends up in the database. The U.S. Department of Homeland Security and Canadian law enforcement agencies have not yet explained why entry was denied. (CBC, 9/9/11)
Marijuana Use Rises, But Declines for Meth and Cocaine
A new government survey on illegal drugs says use of marijuana rose but consumption of methamphetamine and cocaine is trending downward. The National Survey on Drug Use and Health found that pot use rose among Americans aged 12 and older from 5.8 percent in 2007 to 6.9 percent in 2010. That's 17.4 million American teens and adults. The survey, conducted by the Substance Abuse and Mental Health Services Administration, also showed methamphetamine user rates have plummeted by nearly half, from 731,000 users in 2006 to 353,000 in 2010. Cocaine use also dropped from 2.4 million users in 2006 to 1.5 million in 2010. Overall, however, illicit drug use is slightly up, from 8.7 percent of the population in 2009 to 8.9 percent in 2010. Mental, Neurological Disorders Affect 38 Percent of Europeans
New research shows that 38 percent of the European population, or 165 million people, have a mental or neurological disorder. Experts estimate that only one-third of people affected by the disorders get help. Researchers reviewed data from previous studies involving more than 500 million people in 27 European countries, plus Switzerland, Iceland, and Norway. They considered more than 90 mental and neurological problems, including attention-deficit hyperactivity disorder and other problems that are more common in children as well as those typically found in the elderly, such as dementia. The rate of disorders was similar to a study conducted in 2005. Experts not connected to the study say the findings may seem high because most patients don't report their illness and because this study includes disorders in children and the elderly. Half of US Adults Will Have Mental Illness
About half of U.S. adults will develop a mental illness during their lifetime, the Centers for Disease Control and Prevention (CDC) reports. The study also finds that that anxiety disorders are apparently as common as depression and as debilitating in terms of their effects on mental and overall health. There are "unacceptably high levels of mental illness in the United States," said Ileana Arias, principal deputy director of the CDC. The report estimates that the cost associated with mental illness was about $300 billion in 2002. "We know that mental illness is an important public health problem in itself and is also associated with chronic medical diseases such as cardiovascular disease, diabetes, obesity and cancer," Arias says in a statement. "The report's findings indicate that we need to expand surveillance activities that monitor levels of mental illness in the United States in order to strengthen our prevention efforts." Partner Violence Damages Mental Health: Researchers
Victims who suffer violence at the hands of a spouse, boyfriend or girlfriend, or other intimate partner suffer disproportionately higher rates of mental health distress, according to a new policy brief from the UCLA Center for Health Policy Research. Using data from the 2009 California Health Interview Survey (CHIS), researchers found that of the 3.5 million Californians who reported ever having been the victim of intimate partner violence (IPV), more than half a million said they experienced recent symptoms of "serious psychological distress," which includes the most serious kinds of diagnosable mental health disorders, such as anxiety and depression. Adult victims of IPV were more than three times as likely as unexposed adults to report serious psychological distress in the past year. Victims of IPV were also far more likely than non-victims to seek mental health care and to engage in coping strategies like binge drinking. (Psychcentral.com, 8/31/11)
Climate Change Affects Mental Health: Study
Flooding, drought and storms related to climate change have a negative impact on mental health, Australian researchers say. "The emerging burden of climate-related impacts on community morale and mental health—bereavement, depression, post-event stress disorders, and the tragedy of self-harm—is large,” said Tony McMichael, a professor at Australian National University. Statistics from Australia show higher rates of drug and alcohol abuse, violence, family breakups and suicide after extreme weather events, with impacts more pronounced in rural and semi-rural areas according to the report. (New York Daily News, 9/2/11)
Floda Mental Health Groups Protest Changes
A coalition of 13 mental health groups has asked the federal government to help determine whether Blue Cross & Blue Shield of Florida is violating the federal mental health parity law by canceling its psychologists' and mental health counselors' contracts. The move could force some patients to change mental health providers or pay higher out-of-network rates, a provider group says. Not all providers will sign new contracts because of lower rates. (Palm Beach Post, 9/4/11)
Genes May Influence PTSD
A gene that regulates serotonin may predispose individuals to the development of Post-Traumatic Stress Disorder (PTSD) if they experience or witness trauma, according to a new study. Researchers used imaging to study the specific differences in the brain between people who have PTSD and others who have had traumatic experiences but do not have PTSD. They found that people with PTSD had changes in the serotonin 1B receptor, a key neurotransmitter that in animal studies appears to be especially sensitive to stress. And the younger a person was when the trauma occurred, the bigger the difference. The findings, which need to be confirmed by bigger studies, offer a first step in developing drugs specifically designed to target brain changes that occur in people with PTSD. Advocates, Providers Criticize Medicaid Drug Restrictions
Illinois is one of several states that are moving to limit access to brand name psychiatric drugs to people on Medicaid. The state says they consulted with experts before deciding that the less expensive drugs would be acceptable for most patients. But advocates and providers charge the move has made patients worse, with some having to be hospitalized. And they say the state has made it difficult to provide brand name drugs to people who need them. (Chicago Tribune, 9/7/11)

Effects of Combat Stress May Diminish Over Time: A part of the brain’s circuitry called the amygdala may prevent soldiers from developing Post-Traumatic Stress Disorder, a new study asserts. Researchers, whose findings are reported in the journal Molecular Psychiatry, used functional MRI scans to measure activity in this region of the brains of 23 soldiers who were sent to Afghanistan for four months. They compared the results of these scans to those of 16 soldiers who were not sent to Afghanistan before deployment, shortly after deployment and again 18 months later. The amygdala lit up on the scans shortly after deployment among soldiers sent to Afghanistan, compared to those who were not. However, there were no differences in amygdala function between the two groups of soldiers 18 months after returning. Some amygdalas may simply be more resilient than others, researchers say. (Los Angeles Times, 8/30/11)
Mental Health Problems Common Among 9/11 Responders: Mental and overall health problems are common across a large group of 9/11 emergency responders—and remain persistent for 10 to 30 percent of them, according to a new study. The findings, reported in the journal Lancet, reviewed the health of over 27,000 emergency workers. Among rescue and recovery workers, 27.5 percent had been diagnosed with depression and over 31 percent had been diagnosed with Post-Traumatic Stress Disorder. Police officers were at lower risk for mental illness than other responders, according to researchers who say training and experience may have better equipped law enforcement personnel with dealing with traumatic situations. (HealthDay News, 9/1/11)
Child’s Grief over Parent’s Death Can Persist: Grief reactions among children following the death of a parent continue for about 40 percent of those affected, researchers say. They studied 182 children, 7 to 18 years old, who had lost a parent without warning. They were interviewed at several points afterward. Grief was still severe at nine months for 31 percent of the group. Another 10 percent remained intense nearly three years after the parent's death. Prolonged grief appeared to be a significant predictor of new-onset, full-blown depression as well as functional impairment involving school performance, peer relations, and other activities important for children and adolescents, researchers report in the Archives of General Psychiatry. Congratulations to Jessica and Ray Burmester!

On April 28, 2011, Governor Bob McDonnell presented Jessica S. and Raymond F. Burmester with the 2011 Governor's Volunteerism and Community Service Award, in the family category, for their many years of exceptional service to Virginians with disabilities in the areas of mental health, intellectual disability, and substance abuse.

Raymond Burmester is a former co-chair of the Coalition for Virginians with Mental Disabilities. Since the early 1980's the Burmesters have been central figures in the advocacy community. Between the two of them, they have contributed nearly 45 years of unpaid advocacy work. Mr. Burmester continues to serve on the Virginia Disability Commission and the ARC of Virginia, where he was president from 1995-1998. Mrs. Burmester currently serves the Fairfax-Falls Church Community Services Board, the Long Term Care Coordinating Council, and the ARC of Virginia.

ALEXANDRIA, Va. (January 11, 2011)—Mental Health America joins Americans in mourning the loss of those killed in Saturday’s tragic and senseless attack and expressing our wishes for the full recovery of Congresswoman Gabrielle Giffords and fellow citizens who were injured. Our thoughts and prayers are with the families and loved ones of those who lost their lives and everyone who is affected by these horrific events. And we join in applauding the brave actions of individuals who prevented greater harm.

It will likely take many days to understand the reasons and motivations behind this national tragedy. Many have pointed to mental health as an issue.

It must first be emphasized that people with mental health conditions are no more likely to be violent than the rest of the population. And we have science-based methods to successfully treat persons with even the most severe mental illnesses. A very small group of individuals with a specific type of mental health symptoms are at greater risk for violence if their symptoms are untreated.

At the same time, we must recognize that the nation’s mental health system is drastically under-funded and fails to provide Americans living with mental health conditions with the effective community-based mental health services they need. Sadly, in the current environment of strained state budgets, mental health services have been cut drastically just as demand for these critical services has risen dramatically.

It is also important that, as a community, we assist persons with signs and symptoms of mental illnesses to seek treatment. Although rare, when a person becomes so ill that he/she is a danger to themselves or others state laws provide a way to get them help even if they don’t believe that they need it. The best strategy, however, is to have an accessible system of care that is easy to use.

Science has not developed tools to predict reliably individuals at risk for violence. But we can reduce the small risk of violence in those with certain mental health conditions by investing in proven intensive, coordinated community-based mental health services and making certain that they can access these services.

We do not know if the mental health system failed in this situation or if there were missed opportunities or if effective treatment might have averted this tragedy.

We do hope that we can find answers and create solutions that prevent this from ever happening again.

National Survivors of Suicide Day is November 20

National Survivors of Suicide Day is a day of healing for those who have lost someone to suicide. It was created by U.S. Senate resolution in 1999 through the efforts of Sen. Harry Reid (D-Nev.), who lost his father to suicide. Every year, the American Foundation for Suicide Prevention sponsors an event to provide an opportunity for the survivor community to come together for support, healing, information and empowerment.

Capitol Hill Update: Advocates Win Victories on Medicaid, Public Health Fund

As Congress adjourned in early October to return to the campaign trail, advocates could look back at two hard-earned legislative victories: an extension of an enhanced rate of federal funding for Medicaid; and the defeat of an amendment that would have decimated the new health reform law's Prevention and Public Health Fund.

The drive to extend an increase in federal Medicaid matching funds has been a priority of our advocacy efforts because it provides a critical link to needed mental health services for millions of low-income Americans. The American Recovery and Reinvestment Act (ARRA), enacted in February of 2009, included additional Medicaid funding for states by providing higher federal matching rates through the end of December 2010.

However, states are still facing decreased revenues and increased demand for health care assistance as wages have declined and high rates of unemployment continue. In addition, because many states' fiscal years begin in July, the increase was slated to end halfway through the 2011 cycle, leading many to consider cutting benefits and provider reimbursement rates.

To address this problem, an extension of the Medicaid funding increase through June of 2011 was included in legislation introduced in the House and Senate in May (the American Jobs and Closing Tax Loopholes Act of 2010). Anticipating these funds would be available, a number of states have incorporated the increase in their 2011 budgets.

However, the legislation faced opposition because of concerns over its cost and the impact on the deficit.

After the legislation failed to win approval in the Senate on three different occasions, a bill including $16.1 billion in Medicaid funding passed that chamber on August 5. The House returned from its summer recess to approve the bill the following week and the President later signed it into law. Although the bill scaled back the original amount of funding to win needed votes, the aid will help ensure that states can continue providing vital behavioral health care services.

A second victory occurred in September when the Senate defeated by a vote of 46-52 an amendment offered by Sen. Mike Johanns (R-Neb.) to a small business bill that would have gutted the new Prevention and Public Health Fund created under the health reform law. The Fund represents an unprecedented investment in much-needed preventive services, community level prevention and public health. It is urgently needed to address the many emerging health threats our country faces and the persistent chronic disease rates, including behavioral health conditions, which we must begin to control.

Congress is currently scheduled to return to work on November 15 for a lame duck session that could include consideration of a fiscal year 2011 Labor, Health and Human Services and Education spending bill. While neither the House nor Senate versions of that legislation are final, both include increases above the President's request for CMHS, SAMHSA and the National Institutes of Health. Your advocacy efforts are likely to be needed over the lame duck session to reject any efforts to strip away these proposed increases.

Health Care Law May Reduce MH Benefits in Medicaid

A Brief overview from an article in the most recent issue of Psychatric News

As millions more people become eligible for Medicaid coverage in 2014 as a result of the new health care legislation some vital services for mental health and substance abuse consumers may be excluded.

Parity legislation may not apply to the new Medicaid program because some coverage, care coordination and housing support for example, have no counterpart in non-mental health related coverage.

There are some possible solutions.

1. Sates could be bared from restricting coverage. However, this is not likely to happen because of financial strains on the states and the anticipated fiscally conservative character of the new Congress.

2. The definition of the Medicaid essential benefits package could alleviate the shortfall. Thus, the final interpretation of the parity provision is crucial.

CALL TO ACTION - Contact your Senator Webb and Warner’s office. Tell them the unique services for mental health and substance abuse consumers must be protected by including them in the final interpretation of parity requirements.

Sheldon Whitehouse (D-RI), The Health Information Technology Extension for Behavioral Health Services Act of 2010 (S. 3709), would extend financial incentives for adopting health information technology including electronic health records to mental health and addiction treatment providers and facilities. Establishing an interoperable system of electronic health information is critical to encouraging greater care coordination among mental health, primary and other health care providers as well as increased engagement of consumers in managing their own care. Both of these goals are key to improving treatment outcomes and overall health.

By extending financial incentives to behavioral health providers and facilities, S. 3709 would enable behavioral health providers and facilities to engage in the electronic exchange of health information and improve the health and safety of individuals in need of behavioral health services.

It is critical that you tell your Senators to cosponsor S. 3709. In order to improve care coordination and overall quality of care, mental health and addiction treatment providers must be encouraged to implement HIT and engage in the appropriate, privacy-protected exchange of electronic health information.

We urge you to contact your Senators TODAY and tell them to oppose all attempts to use the Prevention and Public Health Fund (Fund) as an offset, including an amendment that is expected to be offered as early as Tuesday, September 14, by Sen. Mike Johanns (R-Neb.) to the Small Business Jobs and Credit Act.

The creation this year of the Fund as part of the Affordable Care Act marked an historic investment Congress in much-needed preventive services, community level prevention and public health. The Fund is urgently needed to address the many emerging health threats our country faces and the persistent chronic disease rates, including behavioral health conditions, which we must begin to control.

But this critical funding is in jeopardy even before it has a chance to reach its goal of expanding and sustaining investment in prevention and public health programs.

Sen. Johanns’ amendment would use the Fund as an offset to the Small Business Jobs and Credit Act, which the Senate will consider tomorrow. If passed, the amendment would eliminate the Fund and mark a severe blow to efforts to transform our health system and promote healthier lives.

Mental Health Parity Act May Affect Your Medical Benefits

The Mental Health Parity and Addiction Equity Act of 2008, by some estimates, could affect the health coverage of approximately 113 million Americans. Exactly how it will affect them, though, will vary widely.

The purpose of the law, which went into effect in July, is to create equal coverage between medical/surgical services and mental health-care services. The legislation requires group insurance plans to offer the same deductibles, co-payments, frequency of treatments and days of outpatient services. The act does not mandate mental health coverage, just equality if it is offered by an employer.

Other provisions of the bill require out-of-network coverage for mental health services, parity of coverage of medical and mental health medications, and if someone is denied coverage of a mental health service that is deemed medically unnecessary by the insurer, patients have the right to find out why.

Behavioral Health Information Technology Bill Gains Sponsors

SUMMARY:
Health Information Technology Extension for Behavioral Health Services Act of 2010 - Amends the Public Health Service Act to expand the definition of "health care provider" for purposes of health information technology provisions to include a behavioral or mental health professional, a substance abuse professional, a psychiatric hospital, a behavioral and mental health clinic, and a substance abuse treatment facility.

Requires the Secretary of Health and Human Services (HHS), acting through the National Coordinator for Health Information Technology, to award grants to eligible entities to: (1) facilitate the purchase of health information technology; (2) enhance the use of such technology, including covering costs associated with upgrading such technology in order to meet the criteria required to become a certified electronic health record (EHR) technology; (3) train personnel in the use of such technology; (4) improve the secure electronic exchange of health information among behavioral and mental health professionals, substance abuse professionals, and other health care providers; (5) improve such technology for adaptation to community-based behavioral health settings; (6) assist with the implementation of telemedicine, including facilitation of distance clinical consultations in rural and underserved areas; and (7) collaborate and integrate with health information technology regional extension centers.

FMAP (Medicaid) Funding in Jeopardy

Bringing you all up to date, Congress (specifically the Senate) has failed to act on passage of the "jobs" bill which contains among other things the extension of the enhanced FMAP from January 1, 2011 to June 30, 2011. This extension would have restored the cuts which are to be effective next week, July 1, 2010.

Last night, an amendment (see attachment-first 2-3 pages) was introduced to the bill which reduces its cost in an attempt to get enough votes to secure passage. In this amendment, the FMAP enhanced rate would be reduced from the current 6.2% to 3.2% (Jan -- March, 2011) and 1.2% (April -- June, 2011).

Please keep in mind that any of the planned reductions in eligibility that would in any way change the existing Medicaid program in each state cannot be used as a result of the passage of the national health care reform legislation.

Senate Finance Committee staff have indicated that a reduction in continued FMAP will trigger the discretionary authority granted the Governor during the reconvened session, meaning he can choose what restorations or additions (in the case of MR waivers and children's MH funding) to make to stay within the reduced FMAP amounts. While the modifications would have been minimal if we receive the full $417 anticipated, the changes will be substantive if we get much less than originally anticipated.

If the US Congress does not pass any continued FMAP, the Virginia budget will be further out of balance because some of the actions to balance it would mean changes in eligibility, no longer options. Just between having to lift the waiver freeze and inability to reduce FPL from 80% to 75%, will mean having to make up $3.7 M in the July I budget and $49M in the second year of this biennial budget, all independent of the provider rate reductions, which is the one item that is not prohibited in terms of states’ Medicaid programs.. That said, let’s hope that Congress will pass some version of continued FMAP to lessen the impact on Virginia’s budget.

The Governor has a number of options to use and we have little indication what may be done but we will keep you informed as we gather information.

ALEXANDRIA, Va. (March 23, 2010)-Mental Health America today hailed the "Patient Protection and Affordable Care Act" signed by the President today. The legislation will greatly expand access to mental health care and addiction treatment-particularly for the 32 million previously uninsured Americans who will gain access as a result.

Treatment for these conditions is recognized as critical to overall health by being included on the list of essential benefits that must be covered in new plans offered to the uninsured.

"This health care reform legislation marks a tremendous step forward in our efforts to improve access to care for individuals with mental health or substance use conditions and in our advocacy for prevention of these conditions," said David Shern, Ph.D., president and CEO of Mental Health America.

The groundbreaking achievement last year with the enactment of the "Mental Health Parity and Addiction Treatment Act" (MHPAEA) firmly established that discriminatory limits on mental health and substance use conditions will no longer be permitted. Mental Health America is pleased to see the health care reform legislation carries this principle forward and extends the MHPAEA requirements beyond current law to health insurance plans offered to small businesses and individuals. These principles are also reflected in the expansion of Medicaid which would require those newly eligible to receive mental health and substance use services at parity with other benefits.

Access to care will also be improved due to insurance market reforms in this new law that will prohibit pre-existing condition exclusions, rescissions of coverage when people most need it, pricing premiums based on health status, and annual and lifetime limits on benefits.

The health care reform law will also establish a new requirement that coverage for dependent children must be available up to age 26 and will provide additional funding for school-based health clinics. Both provisions are critical in light of the fact that mental health conditions often strike during the adolescent and young adult years but most will not receive treatment until many years later, if at all.

Mental Health America places a high priority on prevention, particularly among children and youth, and thus we are please with the new requirements to cover preventive services as well as programs to support community-based prevention activities.

"We also strongly support the provision in this law that will eliminate the donut hole in the Medicare prescription medication coverage as Medicare is a crucial source of support for millions of people with behavioral health conditions," Dr. Shern said.

Among the many other important new programs and reforms are initiatives to support education and training of additional mental health and addiction treatment providers and to improve coordination of care through a new state option for medical/health homes in Medicaid that includes individuals with serious mental health conditions among the priority populations.

Do Kids Come Second in Budget Battle?

It's tough being a kid in Virginia today, especially if mom or dad can't get health insurance on their own. Gov. Bob McDonnell and the House of Delegates have issued budget proposals that would make sure fewer children and pregnant women have access to health coverage than do now. They would deny 30,000 kids and expectant mothers access to the state's health insurance program and make that program among the most restrictive in the nation.

Virginia's children's health insurance program is called Family Access to Medical Insurance Security (FAMIS). It provides health insurance with affordable cost-sharing for 155,000 kids and thousands of pregnant women throughout the commonwealth. FAMIS is available to families who don't have coverage through an employer and can't afford it on their own. Income limits apply; a family of three has to make less than $36,600 a year to qualify.

FAMIS and programs like it have a proven record. Children with health insurance receive regular primary care for basic medical needs and as a result perform better in school, are healthier, on average, than those without insurance, and have a chance to be more productive workers and citizens. Including pregnant women in the program has obvious benefits too, allowing them the prenatal care that can help reduce infant mortality and improve the health and development of the child. In short, FAMIS is more than health coverage; it provides peace of mind to thousands of Virginia's families and is a great investment in the state's future.

And, it's needed now more than ever. The prolonged national recession means more and more Virginians have lost their jobs and the health insurance that went with them. Yet, at a time when the case could be made for opening FAMIS to more kids, the state is on the verge of kicking out thousands.

McDonnell says he would close FAMIS to anyone not currently enrolled. The House of Delegates says reduce income eligibility to a point where a family of three making more than about $31,500 would no longer qualify.

Defending their proposals, lawmakers have left the impression that Virginia is overly generous with health care spending and that the cost of providing care to kids is not merited. In reality, Virginia ranks near bottom in how much we spend on these programs and who is eligible for them. Though the state is one of the 10 wealthiest in per capita income -- which would seem to suggest room to be generous -- only two states spend less per-capita on Medicaid. And 42 states cover children whose families have incomes at higher levels than Virginia's FAMIS. That includes all of our neighboring states. In 2009 alone, 23 states expanded eligibility or simplified enrollment policies. Virginia was not among them.

This is not to deny Virginia has money problems. Like other states it has seen record drop-offs in revenues because of the recession. Certainly, Virginia's $4 billion budget shortfall over the next two years will require tough choices. But 18 states, including several in the South, have dealt with or currently face even larger projected shortfalls in the coming year. Yet only Arizona (which faces a deficit twice as high as ours) and Virginia have chosen to make forcing kids out of their health care programs part of the plan for balancing the state budget.

There are other ways to close the gap between people's growing needs and the state's shrinking resources. But the House of Delegates and McDonnell have rejected a balanced approach that would include new revenue instead of relying only on cuts in spending. And they refuse to curtail generous corporate welfare programs they claim provide incentives to business, without evidence of their effectiveness or attempts to measure results. All they have is wishful thinking in contrast to the rock-solid evidence that investing in kids' health pays off big-time.

Lawmakers say the cuts to FAMIS would save the state more than $37 million over the next two years. Actually it would cost the state much more than that. They ignore that every dollar Virginia spends on FAMIS brings the state almost two dollars in federal funds. So the proposed cuts would mean Virginia forgoes about $70 million in federal funding. That adds up to a reduction of over $100 million in health care services for Virginia's kids and pregnant moms.

And if the health impacts of that are not compelling enough, consider the economic implications. That money doesn't just go into the atmosphere somewhere. It pays doctors, hospitals, and other providers of health care to children. So a $100 million cut means that much less economic activity in the state, further threatening our fragile recovery.

A state's budget reflects its priorities as a society. Closing off FAMIS to thousands who need it would be an unmistakable statement that Virginia's priorities are seriously misplaced.

Federal Appeals Court Rules Against California's Reduction in Medicaid Rates

LOS ANGELES—The U.S. Court of Appeals for the Ninth Circuit reiterated March 3 its oft-stated opinion that California may not cut its Medi-Cal reimbursement rates purely for budgetary reasons, but instead must rely on responsible cost studies, prior to any cuts, to show that the planned reductions do not reduce access to care for Medicaid recipients (California Pharmacists Assn. v. Maxwell-Jolly, 9th Cir., No. 09-55532, 3/3/10).

The ruling, affirming a preliminary injunction granted by a federal district court judge in February 2009 against a planned 5 percent rate cut voted by the Legislature in September 2008 (A.B. 1183), again relied heavily on the Ninth Circuit's 1997 decision in Orthopaedic Hospital v. Belshe, , 103 F.3d 1491. In Orthopaedic, the court held that Section 30(A) of the Medicaid Act requires that payments for Medi-Cal services “must be sufficient to enlist enough providers to provide access to Medicaid recipients.”

That, in turn, required that the Department of Health Services, the predecessor agency to the current Department of Health Care Services (DHCS), “must rely on responsible cost studies, its own or others,’ that provide reliable data as a basis for its rate setting.”

Judge Christina A. Snyder of the U.S. District Court for the Central District of California had granted a preliminary injunction against the A.B. 1183 reimbursement cuts. Snyder cited the Ninth Circuit's decision in Orthopaedic, and said a DHCS analysis supporting the rate reductions was completed well after enactment of the law, and thus did not meet the requirements set out in Orthopaedic.

The challenge to the rate cuts was brought by a group of adult day health care centers (ADHCs), hospitals, pharmacies, and other beneficiaries of the state's Medicaid program, known as Medi-Cal. It was similar to a lawsuit filed in 2008 by other providers protesting a 10 percent Medi-Cal rate cut, which Snyder also blocked, and the Ninth Circuit upheld (Independent Living Center of Southern California v. Shewry, C.D. Cal., No. CV 08-3315 CAS (MANx), preliminary injunction grated 8/18/08) (162 HCDR, 8/21/08).

More recently, Snyder on Feb. 24 granted, on virtually identical grounds as the other cases, a preliminary injunction sought by the California Hospital Association, against state legislation (A.B. 5) that effectively freezes certain designated hospital services at 2008-2009 levels (California Hospital Association v. Maxwell-Jolly, C.D. Cal., No. CV 09-8642 CAS (MANx), preliminary injunction granted 2/24/10).

Rejecting State's Argument

In its appeal of the adult day care centers' preliminary injunction, the state argued that Orthopaedic did not hold that rate-setting had to be based upon pre-enactment legislative studies undertaken and completed by the Legislature itself prior to the action authorizing implementation of the cuts. That case focused solely on the department's actions, and thus only the department was required to consider Section 30(A) requirements, the state maintained.

But the Ninth Circuit three-judge panel disagreed. The court in Orthopaedic did, in fact, focus on the department, since it was setting the rates in that instance. Nevertheless, the state is “misguided” in thinking that focus “absolves the legislature of the same requirements when it sets rates,” Judge Milan D. Smith Jr., who wrote the opinion, stated. In Orthopaedic, the Legislature was “one step removed from the regulations promulgated by the Department,” and thus the Ninth Circuit had no reason to focus on what that body considered before rates were set, Smith noted. “Yet if the legislature elects to bypass the Department, and set rates itself, it must engage in the same principled analysis we required of the Director in Orthopaedic II,” he added

“In sum, we find nothing remarkable in holding that the final body responsible for setting Medicaid reimbursement rates must study the impact of the contemplated rate reduction on the statutory factors of efficiency, economy, quality of care, and access to care prior to setting or adjusting payment rates,” the court wrote. The appellate court also agreed with Snyder that the DHCS's post hoc analysis of the rate cuts did not satisfy the requirements of Orthopaedic. “To satisfy Section 30(A), any analysis of reimbursement rates on the statutory factors of efficiency, economy, quality, and access to care must have the potential to influence the rate-setting process,” the court ruled.

Yet the DHCS analysis of A.B. 1183 with regard to adult day care centers was issued more than five months after enactment of the law, it noted. While that was still before the cuts were actually implemented, the Ninth Circuit was not persuaded by the DHCS's argument that the director could have vetoed the cuts if he determined they did not comply with Section 30(A).

Finally, the appellate court rejected the state's claim that the lower court erred when it found that plaintiffs demonstrated a likelihood of irreparable harm if the preliminary injunction was not granted. In fact, showing a procedural violation of the statute, namely the state's failure to consider the impact of the rate cuts on the statutory factors set forth in Section 30(A), may demonstrate a likelihood of success on the merits that the setting of provider reimbursement rates conflict with Section 30(A), the court stated.

If at least some providers stop treating Medi-Cal beneficiaries as a result of the rate cuts, and evidence indicates that at least some adult day care center providers would stop treating beneficiaries due to A.B. 1183, that might be sufficient for a finding of irreparable harm, Smith wrote.

“We have now handed down multiple decisions instructing the State on Section 30(A)’s procedural requirements,” Smith noted in the court's conclusion. “We trust that the State now understands that in order for it to comply with Section 30(A)’s ‘requirement that payments for services must be consistent with efficiency, economy, and quality of care, and sufficient to ensure access,’ …it must: 1) ‘rely on responsible cost studies, its own or others,’ that provide reliable data as a basis for its rate setting,’ … and 2) study the impact of contemplated rate change(s) on the statutory factors prior to setting rates, or in a manner that allows those studies to have a meaningful impact on rates before they are finalized,” he added. Because the state did neither with regard to A.B. 1183, the district court's order granting plaintiffs a preliminary injunction was affirmed, Smith added.

Reaction to Decision

The DHCS did not return a call seeking comment on the decision.

Lloyd Bookman, of Hooper, Lundy & Bookman in Los Angeles, who along with colleagues Byron J. Gross and Jordan B. Keville, represented the plaintiffs, told BNA March 3 his clients “obviously are very delighted with the Ninth Circuit's decision.”

Bookman also said he hoped the state Legislature, and the DHCS, would heed what the court has said when seeking to adjust Medi-Cal rates.

Senate Bill 30 contains a provision that would reduce the Medicaid eligibility from the current 80% of Federal Poverty Level to 75% of Federal Poverty Level.

-This change will affect approximately 9,950 individuals receiving public mental health services.
-The critical services that the need to remain in the community will be severely impacted: psychiatry, medications, case management, day treatment, and psychosocial rehabilitation
-The reduction will not provide real savings for Virginia because the needs of the individuals must be met with General Fund dollars, especially if the individuals fall back on higher-cost crisis-driven care such as inpatient acute care at state hospitals.
-The eligibility was raised from 75% to 80% in 2001 after a 4 year Hall-Gartlan study of the system, and the drive to maximize Medicaid reimbursement and limit General Fund obligations.

This is a crucial time to raise your voice. In the next weeks, Congress will be deciding whether it moves forward on health reform. In addition, there’s an opportunity to extend vital increases in federal support for state Medicaid programs. But progress on these items won’t happen unless your legislators hear from you. Use the Action Alerts linked below to let Congress know you want them to move on health reform and Medicaid increases.

Health Care Reform: On Thursday, February 25, the White House will host a summit that will bring leaders from both parties together and seek to put health care reform back on track. The summit will be broadcast live on C-SPAN beginning at 10 am EST. Lawmakers will discuss a plan released this week by President Obama that would put families and small businesses in control of their health. The President’s plan adopts the Senate-passed bill while incorporating a number of provisions from the House-passed health care reform bill and other key changes, including a proposal to give the government the ability to block huge increases in insurance rates. This reform plan would cover most uninsured Americans and access to mental health care and substance use treatment would be greatly expanded. In addition, significant steps would be taken to improve coordination between behavioral health and general health care. Additional Medicaid federal financing for all states is also proposed as the President’s plan would eliminate the special provision for Nebraska’s Medicaid program included in the Senate-passed bill. In addition, the Medicare “donut hole” for prescription drug coverage would be closed. The President would also add education and training grants for mental and behavioral health care. In addition, this proposal would support a loan repayment program for pediatric, mental and behavioral health specialists who provide services to children and adolescents in underserved areas or with underserved populations. In addition, new conditions of participation in Medicare would be imposed on community mental health centers to ensure they are providing necessary and high quality care.

Medicaid: The 2009 American Recovery and Reinvestment Act (ARRA) included a temporary increase in federal Medicaid matching funds to help alleviate state budget pressures and prevent cuts in coverage during the current economic downturn. This increase in Medicaid funding ends in December of this year (2010), but states continue to face extraordinary difficulty balancing their budgets for the next fiscal year. As a result many are considering cutting Medicaid benefits and eligibility, as well as provider rates as they develop their 2011 budgets. Senator Jay Rockefeller (D-WV) has introduced a bill, S. 3000, to extend the increased Medicaid funding provided in the ARRA.

The House passed an extension of the increase in federal Medicaid funding in December as part of a jobs creation bill called the “Jobs for Main Street Act” (H.R. 2847). The bill would provide a six-month extension of the increase in the federal Medicaid funds—amounting to $23.5 billion in additional federal funding for states. The Senate has also been working on a jobs creation bill, but the latest version proposed by the Democratic leadership did not include an extension of the federal Medicaid funding. However, the Senate plans to take up additional legislation in the weeks ahead to spur job and economic growth and this legislation should include an extension of the Medicaid funding increase.

State governments and governors are right now in the midst of developing their budgets for next year, and they need assurance that additional federal Medicaid funds will be forthcoming or else we will likely see dramatic cuts in Medicaid coverage. It will also be important to urge that these additional Medicaid funds come with strong maintenance of effort requirements to ensure these funds are only used to preserve Medicaid coverage. As Senate Democrats take steps to spur jobs and provide economic assistance, this is a key opportunity to urge them to include additional Medicaid funds for the states. The new federal mental health parity law became fully effective on January 1 of this year. It states that coverage in most insurance plans (generally those with 51 or more workers) for mental health and substance use must be on a par with your medical and surgical coverage. Good News in Budget

The Obama Administration is proposing a Fiscal Year 2011 Budget that contains increases for most of the nation's public health agencies. The budget, which was released early in February, prioritizes public health programs, including increases in funding for the Substance Abuse and Mental Health Services Administration (SAMHSA), despite a difficult fiscal landscape.

Mental Health America looks forward to working with Congress and the Administration to build upon the proposed budget, which includes a $110 million increase (3.1 percent) for SAMHSA, a $1 billion increase (3 percent) for the National Institutes of Health and a $5.2 billion increase (8 percent increase) for mental health care services at the Department of Veterans Affairs.

Governor's Budget Recommendations: Bad News Gets Worse

Today Governor McDonnell announced his budget recommendations. For a full copy of his speech and specific recommendations go to http://www.governor.virginia.gov/News/viewRelease.cfm?id=47

As a result of the legislature’s rejection of former Governor Kaine’s tax increases the budget has an additional $2 billion dollar hole. Governor McDonnell’s proposal attempts to fill in that hole. His proposal restores some funds to public safety and K-12 and has no further cuts to higher education. However, there are significant cuts in health and human services as well as some other areas.

Now that the Governor has made his proposals they will go to the money committees in the House of Delegates and in the Senate. They will change the recommendations as they see fit and will probably make their report public by Sunday or Monday. Remember that the Governor’s proposals are just that. They will change. So hold on this could be a fast bumpy ride.

Some of the proposals are as follows:

•Reduction of 232 adult psychiatric inpatient beds with savings going to CSBs for crisis stabilization and day support for those who would have been served in state inpatient facilities.

•Consumer directed Medicaid services will be eliminated assumes 50% of people currently in program no longer need care and the other 50% will receive care from agencies.

•Lowers income requirement for long term care Medicaid eligibility.

•Freezes new enrollment into FAMIS

• Additional 10% cut in direct funding to CSBs totaling 15%

•Closure and sale of Commonwealth Center for Children and Adolescents with funds going to community based services, read CSBs.

•Elimination of funds for Healthy Families of Virginia

•Reduction of $1.8 million for Free Clinics

•Eliminate funds for local dental services (currently serves 24,066 people in 24 districts)

•Reduces funding for Virginia Health Care Foundation by 10, 15 and 40% over the next three years

•Eliminates funding for Child Advocacy Centers

There are many other areas of concern so I highly recommend you read the entire document. Health and Human Services starts on page 12 of the document. Block Grants could be at risk again but not to panic yet. I am told by the powers that be individual grants are not at risk.

Mental Health Coalition Legislative Rally!

A wide spectrum of mental health advocates converged on the Capitol of Virginia to increase awareness of mental health issues and meet with there legislators. The rally itself was at St. Peters church, a block away from the Legislative Assembly Building. A number or Virginia Senate and House representatives attended the rally. Plus it was a lot of fun and the weather was beautiful. We just received some pictures that Mira (NAMI Virginia's exec) took at the rally (see below)

Public Heath as Insurance and Shared Vulnerability

Today I was at the Finance Committee hearing on the upcoming Virginia budget. So many people stood up and courageously defended the Medicaid Waivers that are currently on the chopping block. I thought about giving similar personal testimony but as the hearing went on I began to imagine the image of peasants coming to court and begging on the mercy of their King (the fact that delegates were raised above those giving testimony and occasionally cutting them off didn’t help). I think too many Virginians think of public health as a matter of generosity towards those in need, or even a matter of pity. Public health is also an insurance policy. Anyone’s child or grandchild can be born with a mental illness or disability. Psychological trauma is a matter of chance, not socioeconomic status. No one is immune, everyone is vulnerable. That shared vulnerability brings us together. Through our public health system (including Medicaid waivers) Virginians are able to protect each other from the vagaries of fate and the vicissitudes of a sometimes unkind world.
